The Netherlands Gambling Authority (KSA) has decided to collect €4.41m from Malta-based Gammix, despite the company’s objection to its periodic penalty payments.

On June 22, 2022, the KSA imposed an order subject to periodic penalty payments on Gammix of €1.47m per week, with a maximum penalty of €4.41m, for allowing players from the Netherlands to gamble without a licence.

“After several rechecks, it was still possible to play from the Netherlands or create an account. That is why the penalty payments have actually been imposed,” the KSA said in a press release on March 9.

KSA chairman René Jansen said “we have to press ahead when combating illegal supply”.

“An order subject to periodic penalty payments is often effective within administrative law to stop a violation. Not in this case, because the violation has not completely ceased, so we take the next step,” Jansen said.

Under the rules, orders that are subject to periodic penalty payments must allow time for an offender to end the violation. If that does not happen, then the penalty payments must be paid, according to the KSA.

Gammix has indicated it does not agree with the penalty, but that objection has been rejected by the regulator.

In July 2022, Phil Pearson, the director of Gammix, told VIXIO GamblingCompliance that the operator did not allow registrations from the Netherlands during the dates stated in the sanction decision.

“We refute the claims by the KSA and we are respectfully drafting a response and an immediate appeal. The majority of the claims are unproven and unfounded which we will show via a reply to the regulator,” Pearson said.

Gammix can still challenge the collection decision.
